Exminster needs help to ensure that they are heard.  Teignbridge want the Appeal Hearing via written representation, whilst Exminster wants oral representation so they can be asked questions for clarification on relevant points.  They need people to comment on the case via the link below to put public pressure on so they get a fair hearing.

Latest News on Land at Sentrys Farm – October 2014 update

Get Involved Exminster now have a date for the Court of Appeal Hearing in respect of the original Bellway planning permission granted by Inspector Wilde in June 2012.  This will be heard on 17th/18thFebruary 2015.  GIE were granted leave to appeal on ecological and mitigation grounds related to The Exe Estuary Special Protection Area (SPA) SSSI and Ramsar Site which is less than 350metres from the land at Sentry Farm.

It was our understanding that Bovis Homes, who submitted two planning applications last October (13/02614 for 65 houses and 13/02783 for 91 houses), would delay both applications until The Appeal Court decision next year.  However, Bovis Homes have now lodged a planning appeal with the Planning Inspectorate (PINS), on the basis of non determination by Teignbridge District Council of their 65 house application (13/02614).

Bovis Homes and Teignbridge District Council both agree that this matter can be dealt with by the Planning Inspector at PINS by written representations.   This is not acceptable as there are many issues and legal arguments which need to be addressed orally.  A Public Inquiry is the only way that GIE can be included as a Rule 6 Party and have the ability to be fully involved and to be able to cross examine legal arguments put forward by Bovis Homes.  At the very least a Hearing is necessary in order that the Inspector can ask questions.  It is essential that we all ask PINS to reconsider the type of Appeal process and request a Public Inquiry. In addition it may be helpful to include in your communication to PINS some of the following points:

1.       To ensure that PINS are aware of the Court of Appeal Hearing in February 2015 in relation to Mr. Wilde’s decision to grant planning permission in June 2012 on this same site.

2.       That Exminster has now had allocated 2000 plus houses in the TDC Local Plan to the north of the village which will mean that Exminster will more than double in size inevitably  causing great pressures on the already overstretched infrastructure of the village.

3.       That on 13 October there was a revised plan put on the TDC site for 13/02614 the 65 house application now with PINS.  This revised plan has removed the large field (AGLV) which is described as a SANGS (Suitable Alternative Green Space) in the planning application.
