Have just been taking a look at the online planning documents re the supermarket saga and it seems that Tesco are Appealing against the decision made by TDC in March of this year when they (Tesco) were refused planning permission to build at Lady's Mile Holiday Park. The Appeal is scheduled to be heard over 4 days at Forde House, Newton Abbot wef Tuesday 12th October 2010.

But presumably this application refers only to the Tesco application and shouldn't preclude Sainsbury's from getting on with the build of their already approved scheme. But then what happened to the Sainsbury's build and where is it?
From what I can gather Sainsbury's and Teignbridge District Council are still negotiating the finer details of the planning consent given to Sainsbury's back in March. So......presumably until the negotiations are finalised and the planning decision notice is issued, Sainsbury's aren't able to start their build.
Doesnt uually stop the supermarkets, they tend to get on with the build and then take the fines later on.
The Appeal by Tesco was originally held in early October over a period of three/four days. However, as I understand it, so much paperwork did Tesco produce in support of their claim that the three/four days was not enough time. The Appeal was therefore adjourned until a later date so that all this new evidence could be considered. The new date is Monday 20th December 2010 starting at 1.00pm. The Appeal is expected to last up to 3 days and will be heard at Forde House, Newton Abbot. I know no more than that.
